TITLE:  Minor Partition- 4N2803C Tax Lot 808 Sterling Ridge Apartments LLC 1420 NW 11th St 
Subject

The City of Hermiston has received an application from Sterling Ridge Apartments, LLC for a minor partition on property located at 1420 NW 11th St.

Summary and Background

The property is 6.19 acres and contains approximately 3 acres of a 70 -unit multi-family development and 3 acres of vacant land.The proposal will partition the vacant portion of land into a separate lot. The property, zoned Multiple Family Residential (R-3), is owned by Sterling Ridge Apartments, LLC and is described as 4N2803C Tax Lot 808.  The area proposed for partitioning does not abut public right of way.  The city has the ability to waive development code requirements when a parcel is of unusual size, shape, or subject to unusual development conditions.  In this case, the parcel is the undeveloped portion of an existing multi-family lot.  It is not unusual for builders to request partitioning of property to allow for different types of financing.  This is a common practice in commercial development.  In these cases, the city's practice is to require permanent public access easements be provided for the rear parcel as a condition of approval.

 

Public Notice was provided for the proposed partition.  Notice of the proposed land use action was mailed by direct mail to all property owners within 100 feet on February 26, 2020.  A sign informing the public of the proposal was placed on the property on February 26, 2020.

 

The criteria that are applicable to the decision to accept the proposed replat are contained in 154.15 through 154.35, 154.60 through 154.66 and 157.027 of the Hermiston Code of Ordinances.

 

The findings of fact are attached to this report as Exhibit A.  The conditions of approval are attached as Exhibit B.  The map showing the property boundary and adjacent streets and parcels is attached as Exhibit C.  An Aerial photo is attached as Exhibit D. The preliminary plat is attached as Exhibit E.  



Tie-In to Council Goals:

Approval of plats is a matter of administration of city ordinances.

Fiscal Information

There is no financial impact as a result of this partition.  Future development of the parcels will increase tax revenue.

Alternatives

The planning commission may choose to approve or deny the preliminary plat. 

Recommendation

Staff recommends that the planning commission approve the preliminary plat subject to the approval conditions in Exhibit B.

Requested Action/Motion

Motion to approve the Findings of Fact.

Motion to approve the preliminary plat with the conditions and direct the applicant to prepare the final plat.
