TITLE:  Resolution No. 2147- Initiate Vacation E Ridgeway Ave 
Subject

Resolution No 2147 is ready for council adoption.  The resolution will initiate vacation proceedings for a portion of E Ridgeway Ave.

Summary and Background

Chapter 271 of the Oregon Revised Statutes governs disposition of public lands and is the city's guiding policy for processing vacation of public rights-of-way.  Vacations may be processed by petition or by city council motion.  ORS 271.130 establishes that a city council may initiate vacation proceedings by motion without consent of all property owners as required in a standard petition process.

 

At its December 2019 meeting, the Planning Commission approved a 199 unit manufactured dwelling park in the northeast quadrant of town.  A copy of a preliminary site plan is attached to this report for the council's reference. As indicated on the attached map, a full street vacation of approximately 526 feet of E Ridgeway Ave between NE 8th Street and E Diagonal Blvd is proposed. This portion of E Ridgeway Ave is entirely undeveloped right-of-way under city jurisdiction.  The research of the project's surveyor and engineer determined it is unclear if the mapped right of way actually has been dedicated.  As a result, the owner proposes to dedicate 30 feet to E Ridgeway Ave to maintain neighborhood compatibility. 

 

The developer has been working with staff and requests that the city council initiate vacation by motion as opposed to land owner petition. 

 

The right-of-way for E Ridgeway Ave includes a 30 foot wide and a 60 foot wide portion of undeveloped street.  It is not part of the city's transportation plan for the northeast quadrant and the circulation it may provide in the future can be accommodated by E Diagonal Blvd.



Tie-In to Council Goals:

The vacation is proposed to facilitate housing development. Housing is a council priority. 



Fiscal Information

There is no fiscal impact to the city from relinquishing right of way.  Future street maintenance costs are reduced and revenue generated from potential development increases.  Costs associated with vacation will be passed along to the developer.

Alternatives

The city council may choose to:

  • Adopt Resolution 2147 initiating vacation proceedings
  • Reject Resolution 2147 and not initiate vacation proceedings


Recommendation

Staff recommends that the city council adopt Resolution 2147 and schedule a hearing on vacation for May 26, 2020.
