TITLE:  Ordinance No. 2306- Amending Chapter 116 for Mobile Food Vendors 
Subject

An update to Chapter 116 regulating mobile food vendors is ready for adoption as part of the city's comprehensive code update.

Summary and Background

As part of the city's work to update the municipal code, all of the city's ordinances have been reviewed and updates are recommended to reflect current terminology and case law.  The updates proposed are generally not substantive to the city policies regarding mobile food vending.  They are intended to clarify the ordinance language and amend text which has been difficult for the public and staff to interpret.

 

One change that is proposed that is a substantive change is the inclusion of a lunch truck provision.  This provision would allow vendors to set up at a construction site, industrial facility, or office park.  The only permitted time for operation is from 11 am to 1 pm, except for sites which operate on a multi-shift basis.  Multi-shift sites may accommodate lunch breaks for each shift but for no more than 6 hours in a 24 hour period.  Lunch trucks are not permitted to operate at retail and shopping centers.  These provisions are included in 116.11 on page 13 of the attached ordinance.

 

Another provision added is the event license.  This is a request the city often receives from the public, especially retailers and organizations that wish to have a "customer appreciation" event.  In these cases a business, for example an auto dealer, might wish to bring a mobile food unit on-site for one day to generate additional customer traffic.  Event provisions are added to 116.10 on page 11 of the attached ordinance.

 

Finally, provisions for the revocation of a license and appeal of a decision are included in the code.  These are new provisions intended to provide certainty for staff and the public in the due process rights surrounding the ordinance.

Updating and maintaining the city code is a necessary council activity.

Fiscal Information

There is no financial impact from adoption of the revised code provisions.

Alternatives

The council may choose to:

  • Adopt the ordinance as proposed
  • Reject the proposed ordinance and maintain the current regulations
  • Reject the proposed ordinance and direct staff to prepare an amended ordinance for adoption at a later meeting


Recommendation

Staff recommends that the ordinance be adopted as proposed.
