TITLE:  Cooperative Improvement Agreement US 395 - SE 4th Street to I-84 
Subject

An agreement between ODOT and the City is necessary prior to ODOT conducting ADA ramp improvements in the highway.

Summary and Background

ODOT is preparing maintenance activities for Highway 395 extending from SE 4th Street in Hermiston, south through Stanfield and ending at the intersection of I-84.  When ODOT conducts highway work within the boundaries of a city it is necessary for ODOT to enter into a cooperative agreement with any city where work is being done prior to commencement of work.  City and ODOT staff have negotiated the attached agreement for the ADA ramp replacement within the City boundary of Highway 395 south of SE 4th Street to the south city limits at Ott Road.  

 

Much of the agreement is standard language consistent with all agreements between ODOT and the City for other projects.  The terms which are directly applicable to the city fall under the "Agency Obligations" section on pages 2, 3, and 4 of the agreement.  Specifically, the city grants ODOT the permission to close intersections and enter city right of way as necessary for construction activities.  After the project is completed the city will assume maintenance responsibilities for new ADA ramps and sidewalks constructed as part of the project.  Maintenance of subsurface utilities owned by the city will continue to be city responsibility.  ODOT will maintain all storm water drainage facilities for the highway.

Fiscal Information

The City will assume maintenance responsibilities for new sidewalk and ramp facilities constructed as part of this project.  Under the city codes, sidewalk and ramp maintenance are a property owner responsibility.  The city will require maintenance of these facilities as specified in the agreement.

Alternatives

The city council may choose to:

  • Adopt the cooperative agreement with ODOT
  • Reject the cooperative agreement with ODOT


Recommendation

Staff recommends that the city council adopt the cooperative agreement.

Requested Action/Motion

Motion to authorize the mayor to sign the agreement with ODOT on behalf of the city.
