TITLE:  Annexation- Smith 4N2816 Tax Lot 1400- 1030 SW 17th St (Ord 2315) 
Subject

Ordinance No. 2315 annexing 1.38 acres of property at 1030 SW 17th St is ready for adoption.

Summary and Background

Robert and Victoria Smith have submitted an application to annex 1.38 acres of land located at 1030 SW 17th Street.  The property lies within the urban portion of the urban growth boundary and is adjacent to the city limits on the eastern property line abutting SW 17th Street.  The applicant wishes to annex the property to connect to city services.

 

The property is described as 4N 28 16 Tax Lot 1400.  The property has a comprehensive plan map designation of M (Medium Density Residential) which corresponds to a Multi-Family Residential (R-3) zoning designation.  The property contains an existing single-family residence.  The neighborhood contains single-family dwellings to the north and south, multi-family dwellings to the east, and the Umatilla River to the west.

 

SW 17th Street adjacent to this site is a county road improved with paving only.  As a condition of approval for annexation, staff recommends that the applicant sign a street improvement agreement agreeing to participate in future improvements to SW 17th Street, including the installation of curb, gutter, and sidewalk, in the event a local improvement district is formed for this street.

 

150.05 of the Hermiston Code of Ordinances provides the requirements for annexations. The requirements for annexation are as follows:

 

  1. The proposal is in conformance with all applicable state annexation requirements.
  2. The property is contained within the urban portion of the urban growth boundary as identified on the comprehensive plan.
  3. The proposed zoning is consistent with the underlying comprehensive plan designation.
  4. Findings of fact are developed in support or denial of the annexation.
  5. All city services can be readily extended and the property owner is willing to bear costs associated with sewer, water and roads.

 

The planning commission held a public hearing on the proposed annexation on December 9, 2020.  The planning commission received public testimony and considered the proposed annexation.  Following the closure of the public hearing, the planning made a unanimous recommendation to the city council to annex the property with the proposed R-3 zoning designation.

Annexation is a matter of administration of city ordinances.

Fiscal Information

The property has an assessed value of $263,000.  Following annexation, an additional $1,788 will be paid in property taxes to the city annually.

Recommendation

Staff recommends that the city council approve annexation of the property.
