This ordinance is part of the periodic wholesale review of all city code sections begun in sections in 2019. This ordinance specifically updates sections of the City Code relating to System Development Charges in Chapter 34.
Summary and Background
City Attorney Luisi has completed his review and update of the SDC code to bring it current with state law. The existing SDC code is not as old as some other sections of City Code were prior to this wholesale review. The SDC section of Chapter 34 currently dates to 1997. As such, there are no major substantive changes which impact the way that SDC implementation is currently administered in practice.
City Council likely remembers making significant changes with regard to SDC's this Spring. That action was limited to adoption of a new capital facilities plan, which outlines planned projects eligible for SDC funds, and an update to the amount of the SDC fees charged. Ordinance #2328 does not impact the amounts, or methods, of SDC fees as adopted this Spring, but rather just updates the rules for usage of the funds.

Ordinance 2328 has no fiscal impact on the City. This ordinance does not impact the amounts, or methods, of SDC fees adopted by Council this Spring.
