Subject
Ordinance No. 2337 annexing 1.02 acres of property at 80 NE Tracey Lane is ready for adoption.
Summary and Background
Horizon Project Inc has submitted an application to annex 1.02 acres of land located at 80 NE Tracey Lane. The property lies within the urban portion of the urban growth boundary and is adjacent to the city limits on its west, east and southern property line. The applicant wishes to annex the property to connect to city services. If annexation is approved, the applicant intends to develop the property residentially.
The property is described as 4N2802BC Tax Lot 1400 and is owned by Southgate Casper LLC. The property has a comprehensive plan map designation of (C) Commercial which corresponds to an Outlying Commercial (C-2) zoning designation. The property is currently vacant. The surrounding neighborhood is zoned commercial with commercial development to the west, residential homes to the north and east, and vacant lots to the south.
The property does not abut public right of way and is currently serviced through an easement on NE Tracey Lane at the northwest corner of the property extending west to N First St and by a public easement extending to E Theater Lane on the east property line. Horizon Project is purchasing the subject property and tax lot 2300. Tax lot 2300 abuts E Theater Lane and is proposed to provide additional access to the property. Using the land under purchase agreement the applicant will have sufficient access to E Theater Lane to access and develop the property.
150.05 of the Hermiston Code of Ordinances provides the requirements for annexations. The requirements for annexation are as follows:
- The proposal is in conformance with all applicable state annexation requirements.
- The property is contained within the urban portion of the urban growth boundary as identified on the comprehensive plan.
- The proposed zoning is consistent with the underlying comprehensive plan designation.
- Findings of fact are developed in support or denial of the annexation.
- All city services can be readily extended and the property owner is willing to bear costs associated with sewer, water, and roads.
The planning commission held a public hearing on the proposed annexation on February 9, 2022. The planning commission received public testimony and considered the proposed annexation. Following the closure of the public hearing, the planning commission made a recommendation to the city council to annex the property with the proposed C-2 zoning designation.
Tie-In to Council Goals:
Annexation is a matter of administration of city ordinances. The city has a goal to remove as many county islands as possible within the urban growth boundary. This parcel is adjacent to city limits on three sides.
Fiscal Information
The property has an assessed value of $14,800. Property tax revenue is not impacted by the annexation as the property is being purchased by a non-profit organization.
